Condizioni generali (AGB)

§ 1 Provider and scope

1. The provider of FungiFind (fungifind.org) is LIFECO GmbH, Forsthausgasse 16-20/13/7, 1200 Vienna, Austria, company register FN 502150g, VAT ID ATU73826167 (“we”).
2. These Terms apply to the use of FungiFind, including free and paid features.
3. Purchases of paid services are processed by our payment provider Paddle.com Market Limited (“Paddle”) as reseller (Merchant of Record). Paddle’s buyer terms apply in addition to the payment process.
4. Where translations are provided, the German version prevails.

§ 2 Services

1. FungiFind provides probability forecasts for mushroom growth based on weather, habitat and community data, map views, alerts and other features.
2. The feature scope of plans (Free, Season Pass, Plus, Pro) is as shown at purchase on the pricing page. In particular, on-site mushroom identification, medical or legal advice, and a guarantee of finds are not included.
3. We improve FungiFind over time. During a paid term we will not remove or restrict the essential booked features to the customer’s detriment. Changes that are strictly necessary (e.g. lost data sources, legal requirements) will be announced in good time; if the customer is more than insignificantly affected, they may terminate and receive a pro-rata refund for the remaining term.

§ 3 Important mushroom notice

1. FungiFind is not mushroom identification. Forecasts are probabilities and not a guarantee that mushrooms grow at a place.
2. Never eat mushrooms that have not been clearly identified as edible by a competent person (e.g. a mushroom advice centre). Community votes and third-party links do not replace expert identification.
3. When foraging, observe applicable law (forestry, nature protection, property, bag limits, protected areas). Displayed spots do not grant access to private land.

§ 4 Registration and account

1. An account is required for alerts and paid services. Information must be accurate; credentials must be kept secret.
2. Use is permitted from age 16 (or the higher minimum age required in your country for online services). Sensitive psychoactive-species content additionally requires age confirmation of 18+.

§ 5 Contract formation and prices

1. A paid contract is formed when checkout completes. Prices are final prices including statutory VAT where shown. There are no hidden extra charges not displayed before purchase.
2. Season Pass: one-time payment for the stated duration (currently 2 months, €17.99). It ends automatically; there is no renewal.
3. Annual plans (Plus €39.99/year, Pro €99.00/year): 12-month term from purchase. Current prices: pricing page.

§ 6 Price guarantee and price changes

1. The price shown at purchase applies unchanged for the entire booked term. Price changes during a running term are excluded.
2. If we wish to change the price for a subsequent term, we will inform the customer by email and in the account at least 30 days before the term ends.
3. Renewal at the changed price occurs only with the customer’s express consent (e.g. a click in the account). Silence or continued use is not consent. Without consent the subscription ends at term end; no cancellation is required.
4. Price reductions are applied automatically from the next term.

§ 7 Renewal and cancellation

1. At an unchanged price, an annual plan renews for 12 months unless cancelled before term end.
2. We remind by email at least 30 days before each renewal of the renewal date, price and how to cancel.
3. You may cancel anytime without stating reasons with at most two clicks in the account (ideally one click “Cancel subscription” plus confirmation) or by email to kontakt@fungifind.org. Access remains until term end.
4. After an automatic renewal, the customer may cancel anytime with one month’s notice; we refund the unused portion pro rata per our Refund Policy and Paddle rules.
5. Termination for good cause remains unaffected.

§ 8 Discount codes

1. Promo-code discounts apply for the duration stated when redeemed.
2. If a discount is labelled “permanent” (e.g. code “FOUNDER”), it applies while the subscription continues without interruption — including subsequent terms and relative to any later price under § 6.

§ 9 Right of withdrawal

1. Consumers have a 14-day right of withdrawal. The withdrawal notice and practical guidance (including goodwill) are in the Refund Policy.
2. If the consumer expressly asks us to start performance before the withdrawal period ends and confirms that they thereby lose the right of withdrawal, the right ends when digital content provision begins.

§ 10 User obligations

Users must not misuse FungiFind, including automated mass queries (scraping), unlawful or misleading community content, or bypassing technical limits. We may remove content and suspend accounts after warning; for serious breaches without prior warning.

§ 11 User content and privacy

Users grant us a simple, royalty-free right to use content they submit (e.g. find reports, ID votes) to operate and improve FungiFind. Personal data is processed under our Privacy Policy (GDPR).

§ 12 Availability

We aim for high availability but cannot guarantee uninterrupted access (e.g. maintenance, data-source outages). For significant, prolonged outages of paid features we refund pro rata.

§ 13 Liability

1. We are fully liable for intent and gross negligence, for injury to life, body or health, and under mandatory law (e.g. product liability).
2. For slight negligence we are liable only for breach of material contractual duties, limited to foreseeable, typical damage.
3. For damage from eating mushrooms or entering land, § 3 applies; paragraph 1 remains unaffected.

§ 14 Changes to these Terms

These Terms carry version id terms_version 1.0. We announce changes at least 30 days before they take effect. For ongoing paid contracts, changes that disadvantage the customer require their express consent (opt-in). Prices change only under § 6.

§ 15 Final provisions

1. Austrian law applies, excluding CISG. For consumers this choice of law applies only insofar as it does not deprive them of mandatory protections of their country of residence.
2. Statutory venues apply for consumers.
3. Online dispute resolution / consumer ADR: The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are not obliged and currently not willing to participate in dispute resolution before a consumer arbitration board.
4. If a provision is invalid, the remainder of the contract remains effective.
